Maxwell was born in Kent County, Maryland in 1765. He served with the North Carolina regiment, Morgan District, between 1775 and 1783. After the war, John married Jane Brazelton and at some point they settled in South Carolina and then North Carolina. The Maxwells lived at the same place in North Carolina for 21 years, where all their children were born. They moved to Orange County, IN around 1816, right after the birth of their 14th child. During their 13 years in Indiana, they had one more child.

Around 1829, John and Jane Maxwell purchased land in southwest McLean County. They probably moved to McLean County around this time. Although they owned farmland, I believe John and Jane actually lived in Bloominton. John helped found the First Bloomington Christian Church in 1837. According to the 1850 U.S. Census, Maxwell was living with his daughters Jane and Delitha. Also in the household were two children, John M. Pain and Mary J. Pain Smith. They were the children of another daughter, Phebe Maxwell Payne. Phebe, for some reason, does not show up as living in the household in 1850.

Jane died shortly after they moved to Illinois, in 1833. John died in 1857. Maxwell's descendants placed a marker on his grave in 1974.

Interestingly, John's son, John Jr., married Elizabeth Scott, who was the grandaugther of John Scott, another Revolutionary War veteran buried in McLean County. Another interesting fact is that John's son, William, purchased a farm in Bartholomew County, IN in the 1820's. Bartholomew County is named after another Revolutionary Soldier buried in McLean County, Joseph Bartholomew.
